SMS Terms of Use

These SMS Terms of Use constitute a contract between PROVEN Pass Inc. (“PROVEN” or “provenpass.com”) and you regarding your use of our Short Message Service (“SMS”) text-message services, and are incorporated by reference into our Terms of Use.

By using the Services, you agree to these SMS Terms of Use, and you agree that they cannot be modified in any way.  IF YOU DO NOT AGREE TO THESE SMS TERMS OF USE, YOU MAY NOT USE SMS TEXT MESSAGES IN CONNECTION WITH THE SERVICES.

The capitalized terms that appear in these SMS Terms of Use have the same meanings as in our Terms of Use and Privacy Policy, unless they are defined in these SMS Terms of Use.

MESSAGE AND DATA RATES

Please note that message and data rates may apply to your use of our SMS services.

If you have any questions regarding whether message and data rates may apply, please contact your wireless service provider (“Wireless Carrier”).  We are not responsible for such message and data rates.

USING SMS TEXT MESSAGES

Your use of the Services through our SMS text-message services is subject to our Terms of Use and Privacy Policy.

Your employer or another organization may ask you to provide a valid mobile phone number to use our SMS text-message services in connection with the Services.  If you provide your mobile number for this purpose, you will be asked questions and will be asked to provide answer to question about you via SMS text messages.

TERMINATING USE OF SMS TEXT MESSAGES

You can terminate your use of our SMS text-message services at any time by texting STOP to 63687 on your mobile phone.

After you send us a text message containing the word STOP, we will send you an SMS text message to confirm that you have been unsubscribed.  After this, you will no longer receive SMS text messages in connection with the Services.  If you would like to resume your use of SMS text messages in connection with the Services at any time, please advise the company or organization that originally signed you up to use the Services.

FREQUENCY OF SMS TEXT MESSAGES

provenpass.com alerts are delivered via text messaging to your mobile phone, two (2) messages per day, unless you are advised of changes in our message frequency policy.

LIMITATIONS ON LIABILITY

The below limitations on liability are in addition to the limitations on liability contained in our Terms of Use.

You acknowledge that problems can occur when transmitting SMS text messages, and you agree that your Wireless Carrier is not liable for delayed or undelivered text messages.

You acknowledge that PROVEN is not a Wireless Carrier, and you agree that PROVEN is not liable in any way for your use of SMS text messages in connection with the Services.

You agree that PROVEN has no control over whether your employer or any another organization requires you to use SMS text messages in connection with the Services.  Nor does PROVEN have any control over whether your employer or any another organization permits you to “opt out” of using SMS text messages in connection with the Services.  Such requirements and permissions are determined solely by the employer or other organization that asked you provide your mobile phone number to use text messages in connection with the Services.  You agree that PROVEN is not responsible and has no liability for such requirements and permissions.
